Giftcards.com Instagram Sweepstakes (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States and the District of Columbia, who are at least eighteen (18) years old at the time of entry. Void where prohibited. Proof of residency and age may be required. Employees and directors of Blackhawk Network, Inc., Contest Factory and their subsidiaries, divisions, affiliates, and advertising or promotional agencies or individuals involved with the design, production, execution or distribution of the Sweepstakes and the immediate family and household members of such individuals, are not eligible to enter or win. “Immediate family members” shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses, regardless of where they live. “Household members” shall mean people who share the same residence at least three months a year, whether related or not. In order to enter the Sweepstakes or receive the prize, you must fully comply with the Official Rules and, by entering, you represent and warrant that you agree to be bound by these Official Rules and the decisions of the Sponsor, whose decisions shall be binding and final in all respects relating to this Sweepstakes. The Sweepstakes is governed by these Official Rules and is subject to all applicable federal, state and local laws.

Sweepstakes begins February 7, 2024 at 9:00 a.m. Pacific Time (“PT”) and February 9, 2024 at 9:00 a.m. PT (the “Sweepstakes Entry Period”).

The administrator’s computer clock is the official time-keeping device in this Sweepstakes.

To enter the Sweepstakes an entrant must complete the following steps:

1. Access his or her Instagram Account, which must be set to unprotected or public during the Sweepstakes Entry Period and until prize winners are selected and finalized (Instagram privacy setting may be adjusted by selecting the “Settings” menu in Entrant’s applicable Instagram Account).

2. Be a follower of Sponsor’s official Instagram page @gftcards throughout Sweepstakes Entry Period and until prize winners are selected and finalized. If an individual is not currently following Sponsor’s Instagram page and wants to enter Sweepstakes, he or she must go to the handle within the App or instagram.com/gftcards and become a follower. If an individual does not have an Instagram account, he or she can sign up for free by visiting instagram.com and following the instructions.

3. Look for the Sweepstakes post on Sponsor’s Official Instagram Page, @gftcards, follow the online instructions to “like” the post and tag at least one friend as a comment (the “entry”). Once you tag one friend you will receive one entry into that specific Entry Period. You can receive one additional entry for each friend you tag as a comment to a maximum of five (5) total entries per comment to the weekly post within the Sweepstakes Entry Period.

Limit of ten (10) entries per person for the Sweepstakes Entry Period.

Entrants may only use one Instagram Account to enter the Sweepstakes. You are not permitted to share the same Instagram Account with another entrant. Use of any automated system to enter is prohibited and will result in disqualification.

On or about February 12, 2024, Sponsor will select up to five (5) entries for the grand prizes described below in a random drawing of all valid entries received in the Sweepstakes Entry Period. Odds of winning a prize depend on the number of eligible entries received during the Sweepstakes Entry Period. Limit one (1) prize per person every 12 weeks.

6. POTENTIAL SWEEPSTAKES WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR. SPONSOR DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE ADMINISTRATION, OPERATION, SELECTION OF THE WINNER AND OTHER MATTERS RELATED TO THE SWEEPSTAKES.

Prize winner will be considered to be potential prize winner until Administrator confirms his or her prize winner status. Entrant grants Sponsor the ability in its sole discretion to announce the names or any identifiable information of an Entrant/potential prize winner on its Website, Instagram account, or in any other form of public communication. Administrator will notify the potential prize winners by Instagram Direct Message (“DM”). DM will come from @gftcards and include instructions from Administrator that potential prize winner must complete before he or she can be declared a prize winner and eligible to claim a prize. In the event a potential prize winner fails to adhere to DM instructions given by Sponsor or Administrator, the potential prize winner may be disqualified from the Sweepstakes and ineligible to claim a prize or receive any type of compensation. In Sponsor’s or Administrator’s sole discretion, a selected entry of the potential prize winner may be disqualified from the Sweepstakes if he or she: a) is unreachable or unresponsive to notification or attempted notification within 3 days of notification sent, unless another timeframe is stated in the notification; or b) declines or cannot accept, receive or use the prize or any component of the prize for any reason; or c) does not meet eligibility requirements; or d) has failed to comply with these Official Rules; or e) submits a response after the allocated response by date. If for any reason whatsoever a potential prize winner is disqualified from the Sweepstakes, he or she will be required to forfeit the prize and will not receive any kind of compensation, and an alternate potential winner may be selected, at Sponsor’s sole discretion, from among the other eligible entries received.

Five (5) grand prizes will be awarded. Each grand prize winner will receive a $50 Gift Card as displayed in the Instagram post. Prizes are non-returnable, non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the listed prize for one of equal or greater value for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use. ARV of all prizes available is $250.

By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of Sponsor, Administrator which are binding and final in all matters relating to this Sweepstakes; (b) release and hold harmless the Sponsor, Administrator, Instagram and their respective parent, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an Entrant’s participation in the Sweepstakes and/or Entrant’s acceptance, use or misuse of prize.

Except where prohibited or restricted by law, winner’s acceptance of prize constitutes the winner’s agreement and consent for Sponsor and any of its designees to use and/or publish winner’s full name, city and state of residence, photographs or other likenesses, pictures, portraits, video, voice, testimonials, biographical information (in whole or in part), and/or statements made by winner regarding the Sweepstakes or Sponsor, worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of Sponsor, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval.

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an Entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant’s sole remedy is another entry in the Sweepstakes. No more than the stated number of prizes will be awarded.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants, Sponsor or the Released Parties in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws. The parties each agree to finally settle all disputes only through arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in Orange County, California and any other court with jurisdiction over the parties. In arbitration, there is no judge or jury and review is limited. The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Promotion shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS. In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then either party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service. If an in-person hearing is required, then it will take place in Orange County, California. The federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in Orange County, California. Sponsor agrees to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of entrant to attend the arbitration hearing). Either party may, notwithstanding this provision, bring qualifying claims in small claims court.
